Welcome to Navi Baby. These Terms of Service ("Terms") govern your use of our website at navibaby.com.au (the "Site") and your purchase of products from us. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Navi Baby is operated by NB Collective Pty Ltd trading as Navi Baby, ABN 96 698 606 227, based in Sydney, Australia ("we," "us," "our").

You must be at least 18 years old, or have the involvement of a parent or guardian, to place an order with us. By using the Site, you confirm that all information you provide is accurate and current.

Copy, reproduce, or resell any content from the Site without our written permission

3. Products

We offer baby and children's swim, beach, and lifestyle products, including but not limited to hooded poncho towels, pacifiers, and gift bundles. Our product range may change from time to time, including the addition of new categories such as swimwear.

Product descriptions and images: We make every effort to display our products, colours, and prints as accurately as possible. However, actual colours may vary slightly depending on your device's display settings. We do not guarantee that descriptions or other content on the Site are accurate, complete, reliable, or error-free.

Availability: All products are subject to availability. We reserve the right to limit quantities, discontinue a product, or refuse an order at our discretion, including in cases of suspected fraud or error in pricing or product information.

4. Pricing and Payment

All prices are listed in Australian dollars (AUD) and are inclusive of GST where applicable, unless stated otherwise.

We reserve the right to change prices at any time without notice. The price charged will be the price displayed at the time your order is placed.

Payment must be made in full at the time of ordering via the payment methods available at checkout. By submitting payment details, you confirm that you are authorised to use the payment method provided.

We take reasonable steps to ensure the Site is secure, but we are not liable for any unauthorised access to your payment information resulting from circumstances outside our reasonable control.

5. Order Acceptance

Your order is an offer to purchase. We reserve the right to accept or decline any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.

You will receive an order confirmation email once your order is placed. This confirms we have received your order but does not guarantee acceptance. A separate dispatch confirmation will be sent once your order has shipped.

6. Shipping and Delivery

We offer shipping within Australia, to New Zealand, and internationally. Free standard shipping applies to orders over $75 AUD (Australia) and $90 AUD (New Zealand); standard shipping fees apply below these thresholds.

Estimated delivery times are provided as a guide only and are not guaranteed. Once an order has left our warehouse, delivery is managed by our shipping partners (Australia Post or DHL), and we are not responsible for delays, loss, or damage caused during transit outside our control. 7. Returns, Refunds, and Exchanges

We want you to love every piece you purchase. Please refer to our Return Policy page for full details on eligibility, timeframes, and the return process, which forms part of these Terms.

In summary:

Returns must be requested within 30 days of delivery
Items must be unused, unwashed, and in original packaging
Change-of-mind returns are not available for sale items. This does not affect your rights under the Australian Consumer Law
Shipping costs are non-refundable

Nothing in this section or our Return Policy limits any rights or remedies you may have under the Australian Consumer Law, which cannot be excluded.

8. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms is intended to limit or exclude these rights.

9. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, product designs, prints, and images, is the property of Navi Baby or its licensors and is protected by Australian and international copyright and trademark laws. You may not reproduce, distribute, modify, or use any content from the Site for commercial purposes without our prior written consent.

10. Limitation of Liability

To the maximum extent permitted by law, Navi Baby is not liable for any indirect, incidental, or consequential loss or damage arising from your use of the Site or purchase of our products, except where such liability cannot be excluded under the Australian Consumer Law.

Our total liability to you for any claim arising from your purchase is limited to the amount you paid for the relevant product.

The Site may contain links to third-party websites (such as social media platforms). We are not responsible for the content, accuracy, or practices of any third-party site, and inclusion of a link does not imply endorsement.

12. Changes to These Terms
